CHAPTER 7 BANKRUPTCY ATTORNEY

Have An Experienced New Jersey Chapter 7 Bankruptcy Attorney Help Free You From Debt

At the Law Offices of Jeffrey S. Walters LLC, we are experts in helping you obtain the “fresh start” offered by Chapter 7 of the United States Bankruptcy Code.  Simply put, bankruptcy law gives you the ability to discharge (“wipe out”) all or most of your debts and obtain a “fresh start.”

You may have heard of terms like “Chapter 7” or “Chapter 13.”  You do not need to worry about the details. We will help you determine which filing is best for you.

Summary of Chapter 7 Bankruptcy

Chapter 7 Bankruptcy is most useful when you just have a lot of unsecured debt.  Unsecured debts are things like credit card bills, store card bills, medical bills, utility bills and personal loans.  Unsecured debts can also be things like a debt you owe to a former landlord for unpaid rent.  You may have so much unsecured debt that you wish that you could just get rid of it all and get a “fresh start.”  A Chapter 7 Bankruptcy gives you that fresh start by wiping out these debts so that you are no longer legally obligated to pay them.

If you rent an apartment, your lease will not be affected by the bankruptcy and you can just keep living there and continue to pay your rent like normal.  If you want to leave and rent another apartment, any past due rent that you owe your former landlord can be wiped out just like your credit card debts.  You will not be legally required to pay it.

If you own a home and are not behind on your mortgage payments, you can simply keep your house and continue to pay your mortgage just like normal.  If you are behind on your mortgage and just want to abandon your house and move somewhere else, then any amount that you still owe on your mortgage will be wiped out.  You will no longer be responsible to pay it.

If you own a car which is financed and you wish to keep the car, then you can keep making payments just like normal.  If you do not want to keep the car, you can simply give the car back and any amount that you still owe on your loan will be wiped out.  You will not be required to pay it and you cannot be sued for it.

Chapter 7 Bankruptcy is a fairly short process.  It is designed to give you a fresh start and to be over quickly.  After you file, your case will be concluded in 3 months and your debts will be wiped out.

If you own too much property, or do not pass something called the “means test,” then a Chapter 7 Bankruptcy may not be right for you.  That is where a skilled bankruptcy attorney comes in.  Bankruptcy attorney Jeffrey S. Walters is a bankruptcy specialist with the specialized knowledge to analyze your situation to make sure that you benefit from every possible computation which would allow you to file a Chapter 7 Bankruptcy.  If a Chapter 7 Bankruptcy is not right for you, then a Chapter 13 Bankruptcy may be considered.  We are experts in helping people obtain bankruptcy relief and get a fresh start.

Chapter 7 will allow you to:
